SUMMARY OF LARGE PROJECTS
1998
Fleet survey of Brusco Tug & Barge vessels for
underwriting purposes. Working on behalf of Interested
Underwriters surveyed fleet of 15 tugs and barges between
Los Angeles and Columbia River.
1998
Fleet survey of Dutra Dredging vessels for bankruptcy
proceedings. Working for US Bank through the law firm of
Cox, Wootton, Griffin, Hanson & Poulos, surveyed 35 vessels
for condition and valuation.
1998
Discharge/heavy lift survey of new, 3.25 million yacht
built in Taiwan and discharged from deck of freighter in San
Francisco Bay.

Survey of 250’ landlocked gold dredge on behalf of
Interested Underwriters

P&I review of Harbor Bay Maritime vessels and dock
facilities on behalf of Interested Underwriters.

Condition and valuation and subsequent suitability for
tow survey for 105’ ocean going tug in Guatemala purchased
by a client and brought back to the US for reflagging.

Surveyed fleet of tractor tugs specifically to ascertain
whether the machinery condition and maintenance level was
adequate, on behalf of the vessel mortgage holder.
2003, 2004
Survey of the barge “Cativo”, a 300’ deck barge converted
from an oil barge on behalf of the vessel owner. Barge was
condemned for proposed use based upon survey findings, after
another local surveyor had approved the proposed usage for
aggregate hauling.
2004
Purchase surveys of fleet of tugs and barges for
prospective buyer.
2005
Machinery damage survey on 2.2 million Feadship with
shaft failure in Mexico. Followed the vessel up to San Diego
and continued survey activities on behalf of Interested
Underwriters.
2005
Surveyor of record for the at sea disposal of the
Southwest Marine San Pedro dry dock. Dry dock was a
3-section unit constructed with wood pontoons and steel wing
walls and measuring 535’ length overall by 130’ beam and 15’
depth. The wood pontoons had been treated with arsenic over
the years, presenting a potential pollution issue. Shoreside
disposal was ruled out as cost prohibitive. One of the
smaller sections was in poor condition and was not suitable
for towing. This section was disassembled and the wing walls
scrapped. The pontoons were floated onto the remaining
sections and secured. The EPA permit required that the USCG
“Certify” both that the sections were seaworthy and
pollution free. By obtaining a detailed pollution study, and
demonstrating adequate hull condition of the pontoons, the
USCG issued the required certifications and the drydock
sections were disposed of without incident. This project had
been declared to be an impossible feat by the prior surveyor
of record.
2006
Suitability for tow survey on a 120’ inland steam powered
paddlewheel passenger vessel documented for inland waters
only. Vessel was towed from San Francisco Bay to Seattle
without incident. Stability was accessed by a Naval
Architect and found to be adequate for limited weather
conditions. Tow plan specified short legs with weather
windows obtained using 1.5 safety factor.
LITIGATION SUPPORT
1999-2000
Expert witness in Ronald Murphy v. Noyo Maritime, Inc.,
USDC Case No. C-98-4820 CAL. Testified in deposition as to
condition of vessel on behalf of the defendant. Case settled
prior to trial.
2002
Testified in mediation in Raymond Moore v. Boats In
Motion for law firm of Holms Weddle & Bartcott appointed by
Interested Underwriters.
2002-2005
Expert witness in Diana Kaul v. Ray Brands, California
Case No. CIV 211140. Testified in deposition as to vessel
condition and valuation on behalf of the plaintiff through
the law firm of Gibson Robb & Lindh. Case settled in 2005.
2003
Appointed as appraisal umpire in disputed valuation
appraisal on 1967 37’ Pacemaker wood hull yacht under terms
of the insurance appraisal clause. Benson was vessel owner,
Progressive insurer.
2003
Expert witness in Jerico v. KKMI appraisal dispute on a
wood 60’ hull oyster shell dredge that capsized in drydock
on behalf of the defendant through the law firm of Cox,
Wootton, Griffin, Hansen & Poulos. Case was dismissed prior
to testimony.
2003
Expert witness in survey dispute involving a 1971 wood
hull Pacemaker yacht certified as a passenger for hire
vessel. On behalf of the seller through the law firm of
Sterling and Clack.
2004
Expert witness in Baccal v. Sheridan Transportation
Company, California Case No. CGC-03-418698. Consulted with
defendant’s counsel Timothy Lord on case prior to mediation,
where the case settled.
2004
Percipient witness in Wagner v. Bohlman, binding
arbitration involving a dispute in the salvage/wreck removal
of a 51’ sailboat, on behalf of the vessel owner.
2004
Expert witness in Greger Marine v. Bayside Boatworks in
loss of use case involving a tug that was landlocked during
a haulout due to malfunctioning equipment. On behalf of
vessel owner through the law firm of Jedeikin, Green,
Meadows & Schneider. Case is ongoing.
2004
Expert witness in Wilson v. On The Waterfront, litigation
involving boating accident in 2002 resulting in the death of
a wake boarder at Clearlake, CA. Case settled prior to
litigation. 2005-2006 Expert witness in
Love v. Maxwell et al., litigation involving a boat
explosion, on behalf of defendant who manufactured a
component of the fuel tank, through the law firm of Elie &
Associates. Case is ongoing. 2005-2006
Expert witness in Greger Leasing Corp. v. Barge Pt Potrero
on behalf of plaintiff who had the barge arrested for
non-payment of a salvage invoice. Working through the law
firm of Jedeikin, Green, Meadows & Schneider. Case is
ongoing. 2007 Expert witness in Faska v
Quality Performance Marine, Inc on behalf of defendant who
did minor work on a 28’ high performance boat. Plaintiff
alleged that the defendants actions damaged the vessel.
Working through the law firm of Harrington, Foxx, Dubrow &
